Terms of Service

1. Acceptance of Terms

By downloading, installing, or using ScavengerKids ("the App"), you agree to be bound by these Terms of Service. If you are a parent or guardian, you agree to these terms on behalf of your minor children who will use the App.

2. Description of Service

ScavengerKids is an interactive mobile application that creates treasure hunt experiences for children using Bluetooth beacon technology. The App is designed for children ages 4-13 under parental supervision.

3. Account Registration

  • Accounts must be created by parents or legal guardians who are 18 years or older
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account
  • You must provide accurate and complete information during registration
  • One account may have multiple child profiles

4. User Conduct

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App's operation
  • Reverse engineer, decompile, or disassemble the App
  • Create derivative works based on the App
  • Share account credentials with unauthorized users

5. Parental Responsibilities

As a parent or guardian, you:

  • Are responsible for supervising your child's use of the App
  • Consent to your child's participation in the App's activities
  • Are responsible for any charges or fees associated with your account
  • Must ensure the App is appropriate for your child's age and maturity level
  • Are responsible for beacon placement and safety in your play area

6. Intellectual Property

All content in the App, including but not limited to text, graphics, logos, images, audio, and software, is the property of ScavengerKids or its licensors and is protected by copyright, trademark, and other intellectual property laws.

7. In-App Purchases

  • The App may offer in-app purchases for additional content or features
  • All purchases are final and non-refundable except as required by law
  • Parents are responsible for all purchases made through their account
  • We recommend enabling parental controls on your device

8. Privacy and Data Protection

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to our data practices as described in the Privacy Policy.

9. Disclaimers and Limitations

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We are not responsible for:

  • Physical injuries that may occur during gameplay
  • Loss or damage to beacons or other equipment
  • Interruptions or errors in service
  • Compatibility issues with specific devices

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCAVENGERKIDS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

11. Indemnification

You agree to indemnify and hold harmless ScavengerKids, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

12. Termination

We reserve the right to terminate or suspend your account at any time for violation of these Terms or for any other reason at our sole discretion. You may terminate your account at any time through the App settings or by contacting support.

13. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes through the App or via email. Continued use of the App after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law principles.

16. Entire Agreement
